The registration of authorship in Safe Creative provides the author with irrefutable technological proof of his declaration and the consequent protection of his rights (Berne Convention - UN). It is therefore highly advisable to register a work before "moving" it, in order to have a first declaratory proof of its authorship, to publish the work or send previous versions with peace of mind, knowing that the best proof is available in time against those who might be tempted to attribute it.

The main differences between the registration of authorship in a traditional registry and Safe Creative are:

Safe Creative also offers complementary services such as optional public information of the work, registration of related rights (production, distribution, illustration, etc.), registration of "copyleft" licenses, labeling, metadata, link to informative pages of the author, etc.

Any kind of work, document of file can be registered at Safe Creative, however you must be aware that not all works are protected by copyright laws. According to the World International Property Organization’s Berne Convention for the Protection of Literary and Artistic Works copyright include:

Literary works: articles, tales, novels, essays, posts, electronic pages, etc.

Dramatic and audiovisual works: movies, animations, theater, short films, etc.

Musical works: musical compositions, phonographic productions, scores, etc.

Artistic works: drawings, paintings, designs, three-dimensional models, sculpture, engravings,
lithographies, comics, photography, etc.

Databases and software (in some legislations): the code (whatever format) and their manuals and related technical documents, graphics and description modules.

Why can't we register brands, inventions, trade names, ideas, projects, methods, etc?

Trademarks are not artistic, literary or scientific creations (works protected by copyright), but words, symbols, devices or names used for commercial purposes.

To obtain a trademark or a trade name, an administrative procedure must be followed through an official body and the corresponding fee must be paid, similar to what must be done to register a patent, and it is granted for a limited period of time. Read more.

Safe Creative is not a site to register social, economic, festivals, learning methods, concepts, events, etc. projects. Those would be considered ideas by themselves and are excluded to generate copyrights by local copyright laws and international agreements.

When we talk about “projects” in authorship rights contexts we are talking about, for instance, buildings’ blueprints. Read more.

The technological proof generated upon registration is permanently valid. The redundant combination of three different cryptographic technologies (SHA1, SHA 256 and SHA 512 ) for the identification of the work, and two time stamps inscribed in turn on the ETHEREUM blockchain, guarantee its proof validity over time.

Once a work has been registered, you can download the proof of registration, which you can always use as proof of authorship and other registered rights, regardless of whether or not you continue as a Safe Creative user.

What is Creators and how does it work?

Creators is a space where Safe Creative users can activate a creator profile, exhibit their works, sell or license their use and obtain remuneration for them. You can activate your creator profile and include works, if you have an active subscription, or have made a paid registration in the last 12 months.

Steps to follow:

• In the top general menu go to "Creators".
• Click on the top right area, on your image, where it says "My space", to go to your private area.
• In the left panel, click on the editing pencil and prepare your "profile". Don't forget to "Save" before leaving.
• Then go to the "Works" section, which is also in the left menu, and add them by clicking on the large button
• Select one or more of the works you have registered and then click on "Continue".
• Complete the data of the work and "Save changes".
• Indicate what you want to do now from the artwork panel: you can select which one to exhibit, sell or highlight.
• Now you can make your profile public, you already have a biography and artwork. Go back to "My space / profile" and activate the exhibition button.

Publish and sell:

• Go to "Works'' in the menu on the left inside "My space".
• Select a work by clicking on the "Title" .
  Then select the tab "Files and deliverable", to select the file that the buyer will receive and "Save changes".We move to the "Put for sale" tab.  To select the type of license you want to offer, and if you accept to receive proposals requested by the buyer (you can create both).
  In the first case, set the price and click the "Save" button. You will receive an email with information when someone buys the license and the commission of our platform will be deducted (10% + 1 € fixed cost). An NFT or PDF will be generated for the buyer (as desired), which will include the link to the permanent page with information about the purchased license.
   

Buy works:

To purchase a work, know the prices of a license or request a quote, you must first "Login" to Safe Creative or create a new account (free of charge obviously): 

• Select the work you are interested in.
• Click on the "Purchase license" button.
• Select the type of contract you want (PDF or NFT*) and follow the payment instructions (card number, etc).

* If you want to get the contract through a NFT. You need to have previously a wallet linked to your account. To do this, go to the "Link wallet" sector (through Metamask), click on the dropdown in your image and then on "Purchases". 

As a seller, how do I get my money?

• Stripe will transfer the money you receive on a daily basis to the account you have set up. The first transfer can take up to seven days to receive.

Intellectual property registries do not grant rights: the author of a creative work has all of them, moral and patrimonial, without having to register (Berne Convention). However, it is highly advisable to register your work before "moving it", to have a first proof of the authorship established. It is important to do it before publishing your work, sending previous versions and also to be able to offer guarantee of provenance to your clients. You will always have the best proof in time against whoever else wants to attribute it and illicitly benefit from your effort.

Advantages of the digital registration in Safe creative

• The proof of authorship is not based on the presumption of veracity of a public servant, but on the technological evidence that constitutes the identification of the work with three different cryptographic fingerprints, and of the date by the application of a qualified timestamp redundant with a daily audit process on blockchain. 
• International validity: The expertise examination of technological evidences is valid in the jurisdictions of all the Berne Convention signatory countries and recognized by the World Intellectual Property Office (WIPO).

The proof and registration information is permanently valid

The registration in Safe Creative provides(1) two sets of evidences that the author can retain indefinitely to defend her os his rights, because those elements are of permanent validity, whether the user stays active in Safe Creative or not.

• Proof of authorship: The electronic file containing the work, the three cryptographic fingerprints that prove the content and its integrity irrefutably, the double time stamp, which corroborates the date and time of the registration of the rights and audit of all these elements in the blockchain. This proof will always confirm the integrity of all the data registered in any expert examination procedure.
• Authorship and registered rights certificates: Documents in which Safe Creative certifies the details of the information and the registration process generated. The electronic signature of the same guarantees their authenticity and permanent validity.

Safe Creative displays on a public web page the details of the information registered(2) if the registrations are made indicating that the information is public.

Obtaining unlimited certificates, files, tests with active professional services.
While the professional services are active, you can download the registration proofs, certificates and the registered file themselves as many times as you need. 

The best technology for all records and all users.
The technological elements that we use; Triple fingerprinting, redundant time stamping with an approved external service, and Ethereum auditing apply to all registrations, regardless of the type of account the user had at the moment.

(1) The proofs and registration certificates can be downloaded for all express registrations and those made from any subscription account, or by updating to a subscription account if the registration had been made using an amateur account.

(2) Maintenance of the extended publication of the online information page is one year for express registrations and continued for the duration of the account for subscription account registrations.

Both

• Provide a valid presumption of authorship, which admits evidence to the contrary.

Neither

• Is not mandatory and does not grant authorship rights, since the author acquires them simply by creating the work.
• The proof provided by both is based on the date on which the work was already owned and the responsible declaration of authorship was registered; therefore, the greatest protection is achieved by registering the work before making it known, in order to have the best proof in time.

The difference between the two lies in the nature of the proof they provide to the author.

• The official registration of a country provides a signed document as proof. As it has official status in its country, it is admitted as evidence and the veracity of its content is presumed.
  Safe Creative provides as proof a file with a double time stamp to guarantee the date of registration and which contains the work together with three cryptographic fingerprints of the work to confirm that it is the registered work and that it has not been altered since registration. Additionally this information is recorded daily in an audit trail on the Ethereum blockchain.
• The certificate of an official registry has evidentiary character in its own country because it is an official document. To use it in processes in other countries it is necessary to apostille the certificate and that the country where it is going to be used admits the Hague apostille.
• The Safe Creative certificate, due to its technical nature, has international validity as it is independent of the administrative scope of the country where it has been generated.

Not all countries offer an intellectual property registration service.
These differences are related to authorship registrations, not to other types of registrations of an administrative nature that some local registries may offer.

Safe Creative we offerd three types of registration certificates to inform third parties of registered works and copyright statements made and to expand the demonstrative evidence of authorship in favor of the author:

1) Work Registration Certificate.

2) Record of Registration Certificate.

3) Creative Process Certificate.

1)  Work Registration Certificate is a technically irrefutable registration document, independent even of Safe Creative.

This certificate of registration consists of:

• A proof of identity and integrity of the work composed by a triple identification system: SHA1, SHA256 and SHA512 (for registrations prior to 11 of 11 2019 MD5 is displayed instead of SHA256).
• An equally solid proof of the date and time at which the work was registered: Double time stamping independent for each work, made by Time Stamping of Safe Stamper and by Firma Profesional, a certification authority approved in the European Union.

2) Record of Registration Certificate is a document in which appears the information that is registered in Safe Creative regarding the registration and rights registered on a work at that time.

It identifies the work with its registration code, title, author or copyright holder, date of registration and the declared reservation of rights.

3) Creative Process Certificate is the document that gathers all the sketches, notes, intermediate ideas, drafts, etc., dated and time-stamped, that the author kept in his account and that were the basis for the final creative work.

Once the registration of a work has been completed:

- Go to REGISTRATIONS

- Click on the image or the title of the registered work.
- Go to "Creative Process".
- Click on "+ Attach sketches to this registration" and attach all the files and/or folders that will give the original work registered.

The certificate of the creative process corresponding to that work will be generated, to download from "Certificates" having a subscription or upgrading the registration should it be requested by a non-subscription user.
